JumpServe Terms of Service

1. Introduction and Acceptance of Terms

Welcome to JumpServe (the “Service”), provided by Major League Volleyball Inc. DBA JumpServe (“we”, “us”, or “our”). The Service is an online platform designed to facilitate the reservation of sports courts and the management of sporting events, including tournaments, leagues, and other competitive or recreational activities. By accessing or using the Service, you (“User”) agree to be bound by these Terms of Service (“Terms”) and our Privacy Policy. If you do not agree to these Terms, please do not use the Service.

2. Definitions

For purposes of these Terms, the following definitions apply:

  • “User”: Any person or entity who accesses or uses the Service.

  • “Account”: A registered user account created by a User to access certain features of the Service.

  • “Event”: Any sporting event, tournament, league, or activity scheduled and managed through the Service.

  • “Court Reservation”: The process by which users book sports facilities through the Service.

  • “Content”: All text, images, video, audio, data, and other materials provided by users or by us.

  • “Fees”: Any charges, payments, or amounts payable by users for using the Service.

3. Modifications to Terms

We reserve the right to modify or update these Terms at any time. Changes will be effective immediately upon posting the revised Terms on the Service. Your continued use of the Service after any modifications signifies your acceptance of the revised Terms. We will provide notice of material changes to these Terms of Service to the email address you have provided. We encourage you to review these Terms periodically.

4. Eligibility and Account Registration

  • Eligibility: You must be at least 18 years old or have the consent of a parent or guardian if you are under 18 to use the Service. By using the Service, you represent and warrant that you are legally capable of entering into these Terms.

  • Account Registration: To access certain features of the Service, you must create an account. During registration, you agree to provide accurate,truthful, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately if you suspect any unauthorized use of your account.


5. Description of the Service

JumpServe provides users with the ability to:

  • Reserve sports courts based on availability.

  • Create, schedule, and manage sporting events such as tournaments, leagues, and friendly matches.

  • Communicate with other participants and facility managers.

  • Process payments for court bookings and event registrations.

  • Access additional features such as but not limited to event details, analytics and notifications.

The Service may be updated, modified, or enhanced from time to time, and additional features may be added.

6. User Account, Security, and Responsibilities

  • Account Security: You are solely responsible for maintaining the security of your account, including your login credentials. Notify us immediately if you believe your account has been compromised.

  • User Responsibilities: You agree to use the Service in compliance with all applicable laws, regulations, and these Terms. You are responsible for your conduct and all content you submit or post, including event details, reviews, or other communications.

  • Accurate Information: You agree to provide accurate and up-to-date information at all times and to promptly update your account details as necessary.

7. Court Reservations and Event Management

  • Reservations: users can reserve sports courts for designated time slots, subject to facility availability and confirmation by the facility owner or administrator. We are not liable for errors in scheduling or unavailability of reserved courts due to operational issues or forced majeure events.

  • Event Creation and Management: When creating an event, you agree to provide complete and accurate details (e.g., date, time, location, participant requirements, and event rules). You are responsible for ensuring that event details comply with any applicable rules or guidelines.

  • Modifications and Cancellations: Modifications or cancellations to reservations or events must be communicated promptly. Our cancellation, rescheduling, and modification policies—along with any associated fees—will be provided during the booking process. We reserve the right to make adjustments in coordination with facility partners when necessary.

8. Payment, Billing, and Refunds

  • Fees and Charges: Certain features of the Service, including court reservations and event registrations, may incur fees. All Fees will be clearly disclosed before you complete your transaction.

  • Payment Processing: Payments are processed through our third-party payment partners. By submitting your payment information, you authorize us and our partners to charge the applicable Fees. Your payment is subject to the terms of the third-party provider.

  • Taxes: Any applicable taxes will be added to the total fee at checkout. You are responsible for all taxes associated with your use of the Service.

  • Refunds and Cancellations: If applicable, refunds will be handled in accordance with our facility partners and event organizers refund policies and the specific terms outlined at the time of booking. No refunds will be provided for services already rendered unless required by law. Cancellation deadlines and any associated fees will be communicated during the booking process.

  • Billing Disputes: Any disputes regarding billing or payment must be raised within a reasonable timeframe but no more than 30 days; otherwise, they may be deemed waived.

9. User Content and Data

  • Ownership and License: You retain ownership of any Content you submit to the Service. However, by submitting Content, you grant us a non-exclusive, royalty-free, worldwide, perpetual license to use, modify, reproduce, distribute, and display such Content for the purpose of providing and promoting the Service.

  • Accuracy and Legality: You are solely responsible for the accuracy, quality, and legality of the Content you provide. We do not endorse or guarantee the accuracy of any User Content.

  • Data Privacy: Please refer to our Privacy Policy for detailed information on how we collect, use, store, and protect your personal information.

10. User Conduct and Prohibited Activities

  • General Conduct: You agree to use the Service only for lawful purposes and in a manner that does not infringe upon the rights of, restrict, or inhibit the use and enjoyment of the Service by any other party.

  • Prohibited Activities: You agree not to:

    • Engage in fraudulent, deceptive, or misleading practices.

    • Transmit viruses, malware, or any other harmful computer code.

    • Interfere with or disrupt the operation of the Service, including attempting to gain unauthorized access.

    • Post or transmit offensive, defamatory, or otherwise inappropriate Content.

    • Violate any applicable local, state, national, or international laws or regulations.

  • Enforcement: Violation of these provisions may result in the immediate suspension or termination of your account, at our sole discretion.

11. Third-Party Services and Links

  • Third-Party Integrations: The Service may include integrations with or links to third-party websites, services, or applications. We do not control and are not responsible for the content, privacy policies, or practices of these third parties.

  • Use of Third-Party Services: Your use of any third-party services is subject to the terms and conditions of those services. We encourage you to review their policies before engaging with them.

12. Intellectual Property

  • Our Intellectual Property: All content provided through the Service, including text, graphics, logos, images, and software, is the property of Major League Volleyball Inc. DBA JumpServe or its licensors and is protected by intellectual property laws.

  • Limited License: We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Service solely for its intended purposes. You agree not to reproduce, duplicate, modify, or create derivative works from any of our content without our explicit written consent.

  • Trademarks: All trademarks, service marks, logos, and trade names displayed on the Service are the property of Major League Volleyball Inc. DBA JumpServe or their respective owners. Unauthorized use is strictly prohibited.

13. Disclaimers and No Warranty

  • “As Is” Provision: The Service is provided on an “as is” and “as available” basis, without any warranties of any kind, either express or implied.

  • No Warranty: We do not warrant that the Service will be uninterrupted, secure, error-free, or free of viruses or other harmful components. Use of the Service is at your sole risk.

  • Third-Party Content: We do not guarantee the accuracy, completeness, or usefulness of any third-party Content available through the Service.

  • Disclaimer of Liability: In no event shall Major League Volleyball Inc. DBA JumpServe be liable for any direct, indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service.

14. Limitation of Liability

  • Aggregate Liability: The total liability of Major League Volleyball Inc. DBA JumpServe for any claims arising under these Terms or in connection with the Service shall not exceed the amount you have paid, if any, in the twelve (12) months preceding the claim.

  • Exclusions: Some jurisdictions do not allow limitations or exclusions of liability; therefore, some of the foregoing limitations may not apply to you.

15. Indemnification

You agree to indemnify, defend, and hold harmless Major League Volleyball Inc. DBA JumpServe, its officers, directors, employees, agents, and affiliates from and against any claims, losses, damages, liabilities, or expenses (including reasonable attorneys’ fees) arising out of or related to:

  • Your use of the Service,

  • Your Content,

  • Any violation of these Terms,

  • Any infringement of another party’s rights.

16. Termination and Suspension

  • Your Termination: You may terminate your account at any time by following the account termination procedures available within the Service. Termination does not relieve you of any outstanding payment obligations.

  • Our Termination: We reserve the right to suspend or terminate your account and access to the Service, in whole or in part, at any time and without notice, for any business reason, if we determine that you have violated these Terms or if your conduct is harmful to other users or the Service.

  • Effect of Termination: Upon termination, all licenses and rights granted to you under these Terms will immediately cease, and you must promptly discontinue all use of the Service.

17. Governing Law and Dispute Resolution

  • Governing Law: These Terms and your use of the Service shall be governed by and construed in accordance with the laws of the jurisdiction in which the reservation or event was made, without regard to its conflict of laws provisions.

  • Binding Arbitration: Any disputes, claims, or controversies arising out of or relating to these Terms or the Service shall be resolved through binding arbitration administered by JAMS(Judicial Arbitration and Mediation Services) in accordance with its Comprehensive Arbitration Rules and Procedures. The arbitration shall be conducted in Texas, and the arbitrator’s decision shall be final and binding, enforceable in any court of competent jurisdiction.

  • Class Action Waiver: To the maximum extent permitted by law, any dispute resolution proceedings will be conducted solely on an individual basis and not as a class action.

  • Equitable Relief: Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in a court of competent jurisdiction to protect its intellectual property or confidential information.

18. Miscellaneous

  • Entire Agreement: These Terms, together with any policies or guidelines referenced herein, constitute the entire agreement between you and Major League Volleyball Inc DBA JumpServe regarding your use of the Service and supersede all prior or contemporaneous communications, whether electronic, oral, or written.

  • Contractual Supremacy: In the event of any conflict between these Terms and the terms of a separate, written, and duly executed agreement between you and Major League Volleyball Inc. DBA JumpServe, the terms of that written agreement shall govern to the extent of the conflict.

  • Severability: If any provision of these Terms is deemed invalid or unenforceable, that provision shall be severed, and the remaining provisions shall remain in full force and effect.

  • Assignment: You may not assign or transfer these Terms or any rights or obligations hereunder without our prior written consent. We may assign these Terms at our discretion.

  • Waiver: No delay or failure by Major League Volleyball Inc. DBA JumpServe to exercise any right or remedy provided under these Terms shall constitute a waiver of such right or remedy.

  • Force Majeure: Major League Volleyball Inc. DBA JumpServe shall not be liable for any failure to perform its obligations under these Terms due to causes beyond its reasonable control, including, without limitation, acts of nature, war, terrorism, or government action.

  • In addition to these Terms of Service in some cases, your use of the Services may be subject to additional terms and privacy policies. Specifically:

  • sports organizers’ use of the Services may be subject to amended or supplemental terms agreed to directly with JumpServe that alter or modify the Agreement; and

  • sports registrants’ use of the Services may be subject to the terms and/or policies of the third party league organizer through whom the  Major League Volleyball Inc. DBA JumpServe platform is made available. Major League Volleyball Inc. DBA JumpServe  is not responsible or liable for the practices of individuals, organizations and/or entities, including sports organizers, that  Major League Volleyball Inc. DBA JumpServe  does not own or control individuals that JumpServe does not employ or manage. If sports registrants have any questions regarding whether any additional policies or agreements apply to their use of the Services, please contact your league organizer.
